TOWN OF SMELSER

ADOPTION OF ORDINANCE 9-2019

    Please take notice that the Town of Smelser enacted Ordinance No. 9-2019, entitled ATV/UTV Ordinance on September 19, 2019.  The purpose of the ordinance is to open all roads within the Town of Smelser to ATV/UTV usage following the guidelines/rules set forth by Grant County Ordinance No.65 (Chapter 268). All-Terrain and Utility-TerrainVehicle Route

 

Town of Smelser, Grant, County, Wisconsin

 

AN ORDINANCE DESIGNATING ALL-TERRAIN AND UTILITY-TERRAIN VEHICLE ROUTES AND REGULATING THE OPERATION OF ALL-TERRAIN AND UTILITY-TERRAIN VEHICLES 

 

Section I - Intent

The Town of Smelser, Grant County, Wisconsin adopts the following all-terrain and utility-terrain vehicle ordinance/route for the operation of all-terrain and utility-terrain vehicles upon the road ways  in Section III.

 

Section II - Statutory Authority

The applicable provisions of 23.33 regulating ATV and UTV operation pursuant to routes are adopted, as the same may be amended from time to time.

 

Section III - Routes

In accordance with sec. 23.33Wis. Stats., the designated all-terrain vehicle and utility terrain vehicle routes within the Town of Smelser shall be on any township road located within the territorial boundaries of the Town of Smelser.

 

Section IV - Conditions

As a condition for the use of this route, the following conditions shall apply to all

Operators and passengers.

 

(1)   Routes shall be marked in accordance with Chap. NR 64.12(7), Wisconsin Administrative Code. No person may do any of the following in regard to signs marking Town ATV/UTV route.

(a)    Intentionally remove, damage, deface, move or obstruct any route signs if sign legally placed by the state, any municipality of any authorized individual.

 

(2)    In addition to the provisions of sec.23.33, the Town of Smelser adopts in its entirety, Grant County Ordinance No. 65 (Chapter 268) as a part of this  ATV/UTV Ordinance.

 

Section V - Enforcement

This ordinance shall be enforced by any law enforcement officer of Town of Smelser, Grant County, Wisconsin.

 

 

Section VI - Penalties

Wisconsin state All-Terrain Vehicle penalties as found in s. 23.33 (13) (a) Wis.

Stats., are adopted by reference.

 

Section VII - Severability

The provision of this ordinance shall be deemed severable and it is expressly declared that the Town would have passed the other provisions of this ordinance irrespective of whether or not one or more provisions may be declared invalid. If any provision of this ordinance or the application to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provisions to other persons circumstances shall not be deemed affected.

 

Section VIII - Effective Date

This ordinance becomes effective upon passage and publication or posting as required by law.
